Who we are
Operate is made by 1877 Capital Ltd, a UK founded technology company registered in England and Wales, company number 17338653. Our registered office is 66 Paul Street, London EC2A 4NA. In this notice, "we" and "us" mean 1877 Capital Ltd.
We are the data controller for the personal data described in this notice, except where we say we act on your behalf (see "What the Operate apps hold"). 1877 Capital Ltd is registered with the Information Commissioner's Office.
Our data protection contact is hello@1877capital.com. For questions about Operate itself, write to info@operateja.com.
Jamaican operations may in future be run by a Jamaican subsidiary. If that happens we will update this notice to say so.
What this covers
This notice covers operateja.com, the early access form on it, and the Operate apps once you use them. Where Jamaica's Data Protection Act 2020 applies to people in Jamaica, we follow it as well as UK data protection law.
What this site collects
- Early access form: your name, business name, mobile number, email, parish, type of business, stage, team size, and any message you add.
- Emails to info@operateja.com: your address, and what you write to us.
- Basic technical data: your IP address and browser details, which our hosting records for security and to keep the site running.
- Theme choice: whether you picked light or dark. It stays in your own browser's local storage and is never sent to us.
We use early access details to reply to you, to tell you when a place opens, and to understand who the product is for.
What the Operate apps hold
Once you use Operate, it holds:
- Your account data: your name, contact details, sign-in details and settings.
- Business records you keep: sales, stock, invoices, expenses, filings and similar.
- Records about your customers and staff, for example customer contact details, and staff TRN and NIS numbers if you run payroll.
For the last group you are in charge. You decide what is kept and why. 1877 Capital processes that data on your behalf, as a processor, under the Operate service terms. We use it only to provide Operate to you, not for our own purposes. You are responsible for having a good reason to hold it and for telling your customers and staff.
Documents are retired with a reason, not deleted, so there is always a visible record. Cash register sales are recorded, not processed. Operate does not hold or move money.
Sharing and insight
Operate has two separate switches: share a readiness summary, and share with a business advisor. Both are off by default and you can turn either off again. An advisor sees summaries only, never individual sales.
With your consent, we may also use aggregated, information-only insight about groups of businesses. It never identifies a business or a person, and small numbers are suppressed so nobody can be picked out.
We do not sell individual records.
AI features
Operate's AI features process your data only to answer you: to explain, summarize or draft. Results are labeled "Draft", "Suggestion" or "Summary", and you confirm every change. We do not use AI to make decisions about you.
Why we use data, and our lawful bases
Under UK GDPR Article 6 we rely on these bases:
| Purpose | Lawful basis |
|---|---|
| Replying to your early access form or email, and offering you a place | Steps you ask us to take before a contract; our legitimate interests in answering you |
| Providing your Operate account and apps | Contract |
| Service messages: confirmations, security alerts, changes to terms | Contract |
| Security, preventing misuse, keeping logs | Legitimate interests (keeping Operate safe) |
| Aggregated insight, and the two sharing switches | Consent, which you can withdraw |
| Meeting legal duties and answering regulators | Legal obligation |
Who receives data
Service providers who act only on our instructions, under written contracts. We name them by role: hosting and database, email delivery, messaging, and error monitoring. You can ask us for the current list at hello@1877capital.com.
WhatsApp: Operate prepares a message and you send it yourself from your own WhatsApp. We do not send WhatsApp messages for you.
We may also share data with our professional advisers, and with regulators or public authorities where the law requires it. If 1877 Capital is reorganized or sold, this notice would continue to apply. We do not sell personal data and do not share it for advertising.
International transfers
We are based in the United Kingdom, and the UK is our primary place of processing. Operate is for businesses in Jamaica, so some data will travel between the UK and Jamaica, and some of our providers process data in other countries. Where data leaves the UK, we use the safeguards UK law requires, such as the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses.
Jamaica does not have a UK adequacy decision. Where data moves to a country without one, we use safeguards the UK recognizes, such as the International Data Transfer Agreement or the UK Addendum to standard contractual clauses, or another lawful route. You can ask us for a copy of the relevant safeguards.
How long we keep it
| Data | How long |
|---|---|
| Early access details | Until you ask us to remove them, or 24 months after our last contact with you |
| Account data | While your account is open, then up to 6 years where needed for legal claims |
| Business records you keep | While your account is open. You can export them at any time. |
A note on tax records: Jamaican law expects businesses to keep records for at least six years. That duty is yours as the business. Operate helps you keep them.
Your rights
Under UK GDPR you can ask us for a copy of your data, to correct it, to delete it, to restrict or object to how we use it, to receive it in a portable format, and to withdraw consent. You have matching rights under Jamaica's Data Protection Act 2020. Objecting to marketing is always honored.
Email hello@1877capital.com. We respond within one month, and may ask you to confirm who you are first. If your data is in a business's Operate records, we may pass your request to that business, because it decides what is kept.
Complaints
Tell us first at hello@1877capital.com. You can also complain to the UK Information Commissioner's Office at ico.org.uk or on 0303 123 1113. In Jamaica, you can contact the Office of the Information Commissioner at oic.gov.jm.
Children
Operate is not for anyone under 18. We do not knowingly collect data about children.
